Terms of Service

These Terms of Service (“Terms”) govern your use of the Chinook Voice website at chinookvoice.ca and any services provided by Chinook Voice (Alberta Trade Name Registration No. TN28259794) (“we”, “us”, “our”). By using our website or engaging our services, you agree to these Terms.

Chinook Voice is a sole proprietorship operating in Calgary, Alberta, Canada.

1. Services

Chinook Voice designs, builds, and manages AI voice agents for small businesses. Our services are available to clients in Canada and the United States. Services are provided under a separate client service agreement that governs the specific terms of your engagement, including pricing, scope, and cancellation terms. These Terms apply to your use of this website and do not replace your client service agreement.

2. No guarantee of results

AI voice agents are sophisticated tools, but they are not infallible. Chinook Voice makes no guarantee of specific outcomes, including but not limited to call answer rates, lead conversion rates, revenue recovery, appointment bookings, or customer retention. Chinook Voice does not guarantee:

  • That every call will be handled to the satisfaction of every caller
  • That the agent will correctly capture all information in every call
  • That use of our services will result in any specific level of revenue, bookings, or leads
  • That the agent will be available without interruption at all times

Results depend on factors outside Chinook Voice’s control, including call volume, caller behaviour, business type, and market conditions. Our services are provided on a best-efforts basis. We will work with you to address any issues that arise, but we cannot guarantee outcomes.

3. Limitation of liability

To the maximum extent permitted by applicable law, Chinook Voice’s total cumulative liability to you for any and all claims arising out of or related to the services, regardless of the form of action, shall not exceed the total fees paid by you to Chinook Voice in the twelve months preceding the claim.

Chinook Voice is not liable for:

  • Any indirect, incidental, or consequential damages
  • Lost revenue, lost bookings, or lost business opportunities
  • Errors or omissions by the AI voice agent in handling caller information
  • Caller dissatisfaction with the AI agent experience
  • Service interruptions caused by third-party platforms, telephony providers, or internet infrastructure

This limitation applies even if we have been advised of the possibility of such damages.

AI agent outputs

AI voice agent outputs are not guaranteed to be accurate, complete, or error-free. The agent may occasionally produce responses that are incomplete, incorrect, or inconsistent. The client is solely responsible for reviewing and verifying any information communicated by the agent before acting on it. Chinook Voice is not liable for any business decisions, lost sales, missed opportunities, or other outcomes arising from reliance on agent outputs without independent verification.

Third-party infrastructure

Our services rely on third-party infrastructure and AI platform providers. Chinook Voice is not liable for data breaches, outages, errors, or service interruptions originating from those third-party providers. Chinook Voice will notify clients promptly upon becoming aware of any breach affecting their data. Clients acknowledge that third-party providers maintain their own security certifications and privacy practices, which are outside Chinook Voice’s control.

4. Client responsibilities

You are responsible for:

  • Providing accurate and complete information about your business during onboarding
  • Reviewing and approving the agent script before go-live
  • Ensuring that your use of our services complies with all applicable laws in your jurisdiction
  • Notifying us promptly of any changes to your business that affect how the agent should operate
  • Maintaining your own business insurance

5. Acceptable use

You may not use our services or this website to:

  • Engage in any unlawful activity
  • Deceive or mislead callers in a way that causes harm
  • Collect personal information from callers without a legitimate business purpose
  • Violate the privacy rights of callers or third parties

6. Intellectual property

The conversation designs, agent scripts, and configurations we build for you are created specifically for your business. You retain the right to use them for your business purposes. Chinook Voice retains the right to use anonymized learnings from our work to improve our services for other clients. The Chinook Voice name, logo, and website content are our property and may not be reproduced without permission.

7. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Alberta, Canada. If you are located outside Alberta — including in another Canadian province or the United States — you agree that Alberta law and Alberta courts have jurisdiction over any dispute arising from your use of our services.

8. Changes to these Terms

We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of our website or services after a change constitutes acceptance of the updated Terms.
